MANILA -- Drawing of lots is the only way to settle a poll race which results in a tie, according to the Commission on Elections (Comelec). In a press briefing on Tuesday, a day after the October 28 barangay elections, Comelec Chairman Sixto Brillantes explained that the Omnibus Election Code states that cases of ties must be settled by the drawing of lots. A coin toss is usually the method used by the poll body, he said. "Lumang-luma nang nang batas yan. It's in the Omnibus Election Code, which is a 1985 law," he said. "Nagto-toss coin o maski na anong metro kung anong mapapag-agreehan. Gusto niyo magpahabaan kayo ng tingting -- dalawa, hihila yung isa -- pwede rin. Anything by chance pwede, pero generally nagto-toss coin lang," Brillantes said. According to the Comelec, a tie in the counting of votes was reported in one barangay in Pangasinan. However, the poll body said one of the candidates did not agree to settle the result of the race via the drawing of lots. The candidate reportedly insisted that the Board of Canvassers should instead recount the votes. But Brillantes said the drawing of lots must still be conducted, regardless of whether the candidate agrees to it or not. "Hindi niya pwedeng sabihing 'Ayoko.' Iyan ang batas eh... Eh pwede pa rin siyang manalo kahit hindi sumali sa toss coin," Brillantes said.
