Supreme Court Reverses SEBI on Insider Trading | Was SEBI Correct this time?

Supreme Court in a measure ruling has decided to put the onus of proving insider trading on SEBI, which just means more work for SEBI, and we all know that nobody really wants that, but, hey, it's the big court's verdict.

So what does this mean for the crusade against insider trading for SEBI? And how did Supreme Court get to this decision of putting the onus on SEBI to prove that a given case of not to so natural looking big profits and few losses, as is the characteristics of Insider trading?

Well, it all begins with PC Jewellers going public 10 years ago, and the then founders and CEOs splitting. Then in 2018 the extended family at PCJ that left, were accused and penalized by a SEBI WTM for insider trading in buybacks.

However, SEBI failed to prove in court that the family members accused were in contact, as the defense submitted evidence that showed estrangement among the members of the extended family at PCJ. More details on this area are in the video.

But to summarize it all, the situation looks grim for SEBI to dissuade and prevent insider trading, and this will also give a more protective environment to those who are into insider trading, more like a shield if we may say so. And the best part is, nobody really knows if SEBI is the "man" for the job now, as to prove the cases of Insider Trading in India.
